By instructions of the director of the Agency for the Prevention and Fight against Fraud and Corruption of the Valencian Community, the following information is published:
The fundamental rights procedure filed against the AVAF for violation of the right to freedom of association was filed following the dismissal of the official appointed by the free appointment system, with the appellant requesting the annulment of the Agency’s Resolution, as well as a compensation for moral damages.
The Second Section of the Administrative Litigation Chamber of the Superior Court of Justice of the Valencian Community has issued a ruling on July 9, 2024, partially upholding the fundamental rights procedure and consequently annulling the Resolution of the Directorate of the Anti-Fraud Agency, by which the appellant was terminated from the job that she had been occupying by virtue of free appointment as a lawyer of said Agency, without the judgment having agreed on any compensation in her favor in the form of moral damages.
