Participation of the Valencian Anti-Fraud Agency in the Conference “Good corporate governance in the Public Business Sector.” Organized by the Government of the Canary Islands.

The Valencian Anti-Fraud Agency participated, on April 6, in the conference “Good corporate governance in the Public Business Sector.” Organized by the General Directorate of Assets and Contracting of the Ministry of Finance, Budgets and European Affairs, Vice-Ministry of Employment of the Government of the Canary Islands, on April 5 and 6.

The purpose of holding these conferences was to reflect on the good governance of public companies. Thus, an internal and environmental analysis of the public business sector was carried out in the post-Covid19 context, in order to establish and achieve a framework of good governance in the public business sector.

To achieve the outlined objective, the problems and challenges of governance in the Public Sector were started. The principles and tools for effective governance in the entities of the public business sector were transferred to the recipients, through the professionalization of the public sector in various matters, the need to insert innovation and digitalization, and the implementation of tools and Compliance strategies in the public business sector, such as the preparation of risk maps and the establishment of procedures and good practices to identify and classify operational and legal risks.

The event was attended by speakers with extensive knowledge on the subject and who are part of organizations such as: Transparency International, the Canary Islands Technological Institute, the General Intervention of the Canary Islands CCAA, the University of Seville, the Provincial Council of Castellón, the Basque Government, the Consello de Contas, a prestigious law firm, and the Provincial Council of Guipúzcoa, among others.

The representative of the Valencian Anti-Fraud Agency, Irene Bravo Rey, Head of Prevention, participated as a speaker in the panel “Compliance tools and strategies in the public business sector: Procedures and good practices to identify and classify operational and legal risks ”, which he shared together with Eloy Morán, auditor and president of the Technical Commission for the Prevention of Corruption of the Consello de Contas de Galicia and Xabier Unanue Ortega, director of Legislative Development and Regulatory Control of the Basque Government.

The head of Prevention of the Agency focused attention on the importance for the instrumental public sector of having a public integrity system that protects its activity from all kinds of criminal and administrative irregularities, derived from practices contrary to the general interest, protecting all type of public funds, articulating preventive frameworks as the content of their own integrity plans. He continued his presentation, focusing on the importance of the entity’s self-diagnosis, proceeding to make a classification of common and specific risks in the instrumental public sector and the need to evaluate these risks and its methodology to carry it out.

The importance of public ethics and integrity under debate at Cardenal Herrera CEU

The Valencian Anti-Fraud Agency held a university public ethics docu-forum in the classrooms of the Cardenal Herrera CEU University on April 4, 2022,

The training activity took place in the subject of “Administrative Law and Public Administrations” of the double degree in Law and Political Science, and was carried out by Pilar Moreno, AVAF Training Technician.

After viewing the Pandora Box documentary, “Corruption: harmful organism”, the Agency participates in a collective reflection and debate with university students on the importance of ethics in public institutions and the need to prevent conduct contrary to the legal system.

Based on the questions raised by university students, the Valencian Anti-Fraud Agency shares the work and functions carried out by each of the directorates that make up the institution attached to Les Corts.

The session, held thanks to the collaboration of Professor Blanca Nicasio Varea, generated great interest among the students. The process of analysis and investigation and the work of local administration officials with national authorization were some of the issues that generated the most reflections and questions.

The concerns of the university students also focused on the active role that youth can play in putting an end to the fraud and corruption present in some public administrations. How can young people become protagonists in the fight against this scourge that destroys institutional quality?

The Valencian Anti-Fraud Agency participates in the third edition of the University of Valencia’s Master’s Degree in Public Procurement and Compliance

On March 31, 2022, the Agency participated in the teaching of the Master’s Degree in Public Procurement and Compliance of the University of Valencia, in its third edition. Master with a multidisciplinary approach in which, in addition to the Agency, different entities and universities collaborate.

The director of the Agency, Joan Llinares, gave the talk “The function performed by anti-fraud agencies in public procurement” during the last session of the program of this third edition of the Master.

The objective of this training activity has been to raise awareness of the importance of public integrity and ethics to reduce fraud and corruption, by participating in a Master’s Degree in which students are specializing in the different particularities of public procurement, both from private and public perspective. The attention of the Agency has focused attention on the knowledge about risk behaviors that may end up constituting a crime in the course of preparing the administrative file, the award or execution of a public contract.

The director of the AVAF, Joan Llinares, began by contextualizing the anti-corruption policies in the international changes since the 1990s, to follow the regulatory framework in relation to corruption and focus on the development of the functions and actions of the Agency, emphasizing the importance of prevention for good administration, as well as the independence of the Agency.

The final part of the conference focused on the main risks of fraud and corruption that can occur in public procurement, emphasizing situations of conflicts of interest, illustrating in his presentation examples of malpractice that have ended up in court and with convictions.

The director of the Valencian Anti-Fraud Agency ended his speech by thanking the invitation from the University of Valencia and the co-director of the Master, Ángeles Jareño, and wished the students much success in their professional future.
