Participation in the “III Congress on Compliance in the Public Sector”

The Valencian Anti-Fraud Agency participated, on November 30, in the “III Congress on Compliance in the Public Sector” held in Madrid and organized by the World Compliance Association. The celebration of this Congress coincided in time with the entry into force of Order HFP / 1030/2021, of September 29, which configures the management system of the Recovery, Transformation and Resilience Plan and the approval requirement of an Anti-Fraud Measures Plan by any decision-making or executing entity of projects or sub-projects as a condition to receive the European “Next Generation” funds linked to it.

The Congress addressed the different regulatory elements that make up the prevention and fight against corruption, within the framework of European requirements in terms of institutional integrity, focusing on the importance of anti-fraud plans in the management and control of funds Europe, as well as various issues related to conflicts of interest, the anti-fraud cycle (detection, prevention, prosecution and correction), the importance of whistleblower channels as detection tools and the growing role of new technologies throughout the cycle anti fraud.

The event, directed by Concepción Campos Acuña, Secretary of the Vigo City Council, was attended by speakers with extensive knowledge on the subject and who are part of organizations such as: the University of Castilla la Mancha, the National Institute of Aerospace Technology, the Anti-fraud Office of Catalonia, the Office for the prevention and fight against corruption of the Balearic Islands, the Consello de Contas de Galicia, the Transparency Agency of the Metropolitan Area of ​​Barcelona, ​​the Legal Services of the Community Board of Castilla-La Mancha , the Mollet del Vallés City Council, the National Anti-Fraud Coordination Service, or the National Court, among others.

The representative of the Valencian Anti-Fraud Agency, Irene Bravo Rey, Head of Prevention, focused attention on the control of the anti-fraud plan, explaining the different instances and control mechanisms, and emphasizing the necessary separation between the functions of management of the plans and their control, the confusion of both constituting one of the main vulnerabilities of the systems linked to European funds analyzed by OLAF, among other entities. Likewise, Irene Bravo focused on the need for every public entity to have an integrity plan that protects all types of public funds (not only European ones) and covers irregularities of an administrative nature, beyond risks of criminal corruption.

“Training in integrity: an emerging need for public administration” was the title of the presentation presented by #TrainingAVAF of the Valencian Anti-Fraud Agency within the framework of the CNIS congress on November 25.

Anselm Bodoque, head of the AVAF Training Service, presented the Agency for the Prevention and Fight against Fraud and Corruption in the Valencian Community. The prevention and eradication of fraud and corruption in the Valencian public administrations and the promotion of integrity and public ethics were the reasons for the creation of the AVAF, together with the promotion of a culture of good practices and integrity in design, execution and evaluation of public policies, as well as in the management of public resources.

The Strategic Training Plan of the Agency, approved in September of this year, and its most important lines, were also presented to the attendees.

Public officials from all administrations with attention to those at the local level and the Generalitat Valenciana, together with students from Valencian universities, children and adolescents and organized civil society are the protagonists of the training activities of the AVAF.

Pilar Moreno, a training technician at the Valencian Anti-Fraud Agency, shared the learning experiences that the AVAF has developed over the last few months.

He made a special reference to the longest-running training activity of the AVAF is the documentary “Corruption: harmful organism” prepared by Pandora Box. All the universities of the Valencian Community have had the opportunity to visualize it and transfer to their classrooms the debate on the fight against corruption, the protection of whistleblowers, as well as the tools that youth have to say no to corruption.

In the same way, he referred to the activities carried out together with the Alicante and Valencia councils, or the National Institute of Public Administration for public officials, and the Unisocietat activity, together with the University of Valencia, aimed at citizens in a decentralized manner.

Networking with all the actors of the institutional system, associations, universities, professional associations, as well as public institutions is essential to continue with the work of training and prevention of corruption.

The Valencian Anti-Fraud Agency and the Valencia Provincial Council united by the «New challenges of Public Sector Contracting: ODS and Next Generation Funds»

The AVAF has participated in the course “New challenges in Public Sector Contracting: ODS and Next Generation Funds” organized by the Valencia Provincial Council, and coordinated by Ylenia Diaz, general secretary of the Riba-roja del Turia city council and Cristina González Gabarda of the Valencia Provincial Council.

The reporting channels as an instrument for the achievement of solid institutions of SDG 16 has been the title of the conference given by the Agency within the framework of the DIVAL course.

The SDG 16 of the 2030 Agenda, focused on the promotion of just, peaceful and inclusive societies has been the guide of the course. “Significantly reduce corruption and bribery in all its forms” (SDG 16.5) and “Create effective and transparent accountable institutions at all levels” (SDG 16.6) have been present in the development of the learning experience.

The director of the Valencian Anti-Fraud Agency, Joan Llinares, shared with the students the background of the AVAF, the functions attributed by Law 11/20216 to create the Agency (prevention, training, documentation, protection of whistleblowers, analysis and investigation ) as well as the alerts received in the complaints channel regarding public procurement.

The Order of the Ministry of Finance and Public Function HFP / 1030/2021, of September 29, which configures the management system of the Recovery, Transformation and Resilience Plan. He introduced the obligation to develop and approve anti-fraud plans for all those organizations that were to manage funds. Next Generation was also present throughout his speech.

As detailed in the aforementioned guide, “It is not enough to approve a public integrity plan and publish it. With that, the entity will have put on the number, but, to start the race, it will have to become aware of the importance of said plan and put it into practice at all levels of its organization, as part of a process that implies dedication, continuous improvement efforts and actions, but which will undoubtedly be very positive for elected officials, public managers, public employees and for the general public. “

The complaint channels, one of the manifestations of the institutional integrity system, has focused the presentation of Gustavo Segura, director of analysis and investigation of the Valencian Anti-Fraud Agency.

The public employees selected by the Valencia Provincial Council have had the opportunity to approach the complaint channel tool that the Agency has and that can be used as an external complaint channel that all public entities must have at their disposal. as of December 18, 2021.
