The public control mechanisms of the Next Generation European Funds

On May 26, Quart de Poblet hosted the conference “The mechanisms of public control of European funds Next Generation”, given by the professor of Administrative Law at the University of Valencia, Reyes Marzal Raga.

The Valencian Anti-Fraud Agency actively participates in the Unisocietat program because it is an instrument to carry out training activities in a decentralized way, where the citizens of the different regions and localities of the Valencian territory are the protagonists of the debates and reflections that are generated.

Sílvia Vèrnia, Director of Prevention, Training and Documentation of the AVAF, presented the activity within the framework of the existing collaboration agreement between the Valencian Anti-Fraud Agency and the Vice-Rectorate for Territorial Projection and Society of the University of Valencia. He also presented the Agency, insisting on its functions and independence, and explaining the general concern for the proper planning and management of European funds in the context of the European Recovery Plan.

Professor Reyes Marzal, presented the European Next Generation mechanism or, European Recovery Fund created to overcome the consequences of the Covid-19 health crisis.

The member states must approve their corresponding national plans, which establish their reform and investment programs until 2016. Spain has started this procedure with the approval of Royal Decree Law 36/2020, of December 30, which they approve the urgent measures for the modernization of the Public Administration and for the execution of the Recovery, Transformation and Resilience Plan, “Plan España may” for 140,000 million euros.

He indicated the objectives of this plan, as well as the financial mechanisms to develop it and its conditions. Likewise, he made reference to the proposal of Spain in its central axes, policies, lines of action and the mechanisms of execution.

The conference was face-to-face, taking into account the anticovid measures established by the pandemic. The audience, 15 people from the UNISOCIETAT program in Quart de Poblet, was very interested in how European funds will be managed until 2026 and actively participated in the debate.

Covid-19 and fundamental rights, protagonists in Unisocietat Alzira

On May 25, the Professor of Constitutional Law at the University of Valencia, Sefa Ridaura, gave the presentation “Covid-19 and fundamental rights” in the UNISOCIETAT conference cycle, in face-to-face format, within the framework of the collaboration agreement existing between the Valencian Anti-Fraud Agency with the Vice-Rector’s Office for Territorial Projection and Society of the University of Valencia.

Joan Llinares, director of the AVAF, has presented, in the city of Alzira, the conference where the exercise of fundamental rights in the Spanish constitution of 1978 and what rights can be affected during the declaration of exceptional states have been the protagonists . The possibility of limiting fundamental rights without the coverage of the state of alarm has also focused the conference.

The public attending, 22 people, attending the anticovid measures stipulated by the pandemic, has actively participated by asking questions, which have focused on understanding how the declaration of the state of alarm has affected their fundamental rights.

32% of the complaints filed with the Valencian Anti-Fraud Agency during 2020 were about public procurement

Valencia, May 25, 2021.– In 2020, a total of 226 complaints were filed at the Valencian Anti-Fraud Agency, 34% more than in 2019. Regarding the subject matter of the complaint, 72 of the 226 complaints filed , that is, 32%, referred to public procurement.
If we analyze in detail that 32% of complaints filed about hiring, 19% of the cases refer to service contracts; 5% for concessions; 3% to supply contracts and 2% to works contracts.
In second place with respect to the matters most reported to the AVAF is the management of human resources, with 28% of the total, that is, 68 complaints. Of these 68 complaints, those that refer to selective procedures and the provision of jobs are the ones that have accounted for the largest number of complaints with a total of 50 complaints filed.
For their part, subsidies have accounted for 12% of complaints in 2020; followed by 10% by complaints about urban planning and the environment, and by 4% by complaints about heritage. The remaining 14% of the complaints are included under the heading of “others”, since they deal with issues that do not easily fit into the traditional areas of activity carried out in the general administration.
If we compare these data with those of the previous year, we see that public procurement has gone from occupying the second place in 2019 with regard to the complaints filed, with 25% of the total, to occupying the first place in 2020 with the 3. 4%. Likewise, complaints about aspects related to human resources have gone from 40% of complaints filed during 2019 to 28% during 2020.

The most significant drop has been registered, despite the complaints that refer to the misuse of public resources that represented 16% of the complaints during 2019, with 27 complaints filed, and which practically disappeared in 2020 since only a complaint for this concept was registered throughout the year.
Among the functions entrusted to the Valencian Anti-Fraud Agency are the functions of prevention and training against fraud and corruption, with special emphasis on the construction of public ethics and integrity.

For this reason, a course on “Integrity and Prevention in public procurement in the Valencian Community” has been organized together with the Valencian Institute of Public Administration (IVAP). This training activity is aimed at personnel who work in the administration of the Generalitat Valenciana, especially those related to the recruitment area.
