The Valencian Anti-Fraud Agency shows its work at the VIII International Congress of Transparency and Open Government in Alcalá de Henares

The AVAF has been present at the VIII International Congress on Transparency and Open Government held at the Faculty of Law of the University of Alcalá de Henares from September 27 to 29, 2023.

Teresa Clemente, deputy director of the Legal Affairs Directorate of the AVAF, presented the oral presentation “The impact of Law 2/2023 in the Valencian Community”. In it, he explained the effect of Law 2/2023, of February 20, regulating the protection of people who report regulatory infractions and the fight against corruption in autonomous communities with prior existence of competent authorities.

In particular, he detailed the protection of whistleblowers in the Valencian Community. The application of state law and what is established in the specific Valencian regulations is a core part of the exhibition, as well as the non-regression clause and the maintenance of the most favorable provisions for the rights of the person who reports.

The presentation presented was well received among the public specialized in the subject participating in the working group and generated an intense and very interesting debate.

Juan Vega Felgueroso, lawyer from the Valencian Anti-Fraud Agency, presented a paper with an oral presentation on “Evolution of transparency in the financing of parliamentary groups.”

The lawyer from the Legal Affairs Directorate of the AVAF analyzed the impact, in terms of transparency, of the agreement of the Corts Valencianes, regulator of the accounting and control of subsidies of parliamentary groups, based on the fact that said agreement created, ex novo, a control regime over the transfer of public funds from parliamentary groups to political parties.

The presentation presented by the AVAF lawyer caught the attention of the expert audience of the GT23-17 working group. Political parties, electoral participation and transparency, coordinated by María Salvador Martínez.

Pilar Moreno García, technician of the AVAF Training Service, participated in the working group 23-03 “Ethics and public integrity” with the paper with oral presentation “Training in integrity, the key to the vault of the institutional system. Contributions from the Valencian Anti-Fraud Agency.” Pilar Moreno explained that the priorities and training strategy of the Training Service of the Valencian Anti-Fraud Agency are the promotion of integrity, ethics and public values, through training as a tool for the transformation of public administration.

Prioritizing training in ethics and civic culture of Valencian citizens necessarily implies helping in the development of a critical, participatory, responsible spirit, which is the basis for strengthening institutional and democratic quality.

The protagonists of the integrity training developed by the AVAF are the public employees of all administrations, with special attention to those of the local administrations and the Generalitat Valenciana, together with Valencian university students, children and adolescents.

The International Congress of Transparency and Good Government held in Alcalá de Henares has hosted various meetings of organizations dedicated to improving open government such as the “Network of local entities for transparency and citizen participation of the FEMP”, the “Academic Network of Government Open” or the meeting of the Chairs of Transparency and Good Government.

The AVAF participates in the II Valencia Public Procurement Congress “Smart public procurement”

The director of the Valencian Anti-Fraud Agency, Joan Llinares, participated in the II Public Procurement Congress, held at the ADEIT, on September 28 and 29, 2023.

“Technology applied to the detection of fraud, corruption and conflict of interest in public procurement” was the round table in which the AVAF presented its work and was moderated by Beatriz Montes Sebastián, a career civil servant lawyer. María del Mar Rodríguez Polack and Miguel Calvo Aníbarro, audit team leader and supervisory national investigative analyst, respectively, both belonging to the National Anti-Fraud Coordination Service, participated in the table on the detection of fraud and corruption on Friday, September 29. , of the General Intervention of the State Administration, belonging to the Ministry of Finance and Public Function.

Also part of the round table were the speakers Álvaro Casillas Pérez, head of the Specialized Advice Unit on Conflicts of Interest of the General Intervention of the State Administration of the Ministry of Finance and Public Function, and Carmen Longares Penadés, coordinating inspector of the AEAT Valencia Special Delegation of the State Tax Administration Agency.

The congress was promoted by the Department of Finance and Economic Model of the Generalitat Valencia and the University of Valencia, with the collaboration of the Association of Women in the Public Sector.

The intervention of the director of the AVAF, Joan Llinares, focused on explaining the prevention and investigation work of the Valencian Anti-Fraud Agency, paying special attention to the risks of contracting and the need to establish effective alarm and prevention systems.

The Valencian Anti-Fraud Agency (AVAF) has provided, for yet another year, training at the Valencian Institute of Public Administration. The 20-hour course took place 100% online, over 5 sessions of 4 hours each, in which specialized AVAF personnel offered the entire training.

“Public Integrity Policies and Prevention of Fraud and Corruption Risks” has been the new course taught by the Agency, which in its first edition has had the objective of raising awareness of the institutional system against corruption in Spain and in the region of Valencia on the occasion of the recent approval of Law 2/2023, regulating the protection of people who report regulatory infractions and the fight against corruption, as well as the existence of the Valencian Anti-Fraud Agency.

The inauguration of the course, in the session of September 13, 2023, was carried out by Joan Llinares, director of the AVAF. Subsequently, Teresa Clemente, deputy director of the Agency, explained Law 2/2023 in the first presentation of the training.

The director’s intervention highlighted the value of qualified training in public integrity in the prevention and fight against corruption strategy.

For her part, Teresa Clemente explained the protection system for informants or whistleblowers, and the pioneering work in this matter of the Valencian Anti-Fraud Agency.

On Friday, September 15, the AVAF Analysis and Research Directorate spoke about the importance of the information systems of Law 2/2023. Miguel Furió, head of the Analysis and Research Service, explained the existence of internal and external channels. How to implement a complaints channel in 60 minutes was the challenge presented in the presentation given by Javier Alama, head of the Agency’s ICT Service.

The Agency’s Prevention Service developed the session on September 18 with the participation as teachers of Irene Bravo, head of the Prevention Service, and José Mari San Martin, legal prevention technician. Public integrity plans and risk preventive systems in public management focused the interventions of both teachers.

Anselm Bodoque, head of the AVAF Training Service, developed throughout the session on Wednesday, September 20, the consequences of corruption and anti-fraud policies in the international, state and Valencian context.

In the last session of the course “Public Integrity Policies and Prevention of Risks of Fraud and Corruption”, on Friday the 22nd, the leading role belonged to the students participating in the training process through the workshop “Corruption: harmful organism” and “Conflict of interest ” energized by the AVAF Training Service, formed by Anselm Bodoque, Pilar Moreno and Marita Oliver, training technicians of the Agency. The workshop generated an intense and extensive debate among course participants.

The Valencian Institute of Public Administration is the body responsible for the training policy of personnel at the service of the different public administrations of the Valencian Community.
